Divorce with financial and property claims

Financial and property claims within divorce cause a lot of distress and can have lasting consequences for the couple and children. Resolving financial and property disputes when divorcing

 

If you would like to resolve financial and property matters with your former spouse once and for all, a financial order from the family court is required. Obtaining decree absolute does not mean that financial difficulties will be resolved immediately, and the financial claims resulting from the dissolution of the marriage will remain open.

 

We propose that at the same time as the divorce proceeds, you settle the financial entitlements that you and your spouse have in relation to cash, property, pensions, investments and assets of any kind as well any income claims (ie maintenance). This would ensure there is a financial clean break and that no further claims can be made by either side.

 

Financial Remedy

 

Financial remedy is the name of the court procedure between you and your partner to determine financial disputes. It is the mechanism by which the court deals with all forms of financial settlement, including land transactions or purchases, payment of lump amounts by one party to the other, maintenance orders (both for spouse and child), and how to split pensions.
