The Heroic Legacy of Dr. Mark Baker: Courage, Sacrifice, and Justice

The selflessness and bravery of individuals often leave a mark that resonates through the generations. Such is the story highlighted in a recent episode of Antiques Roadshow, featuring the Albert Medal awarded to Mr. Wileman for his courageous attempt to save a colleague during a tragic incident in Ticknall, 1955.
This medal commemorates an event, steeped in local history and heroism, that not only left an emotional impact on the community but also had significant legal implications, shaping workplace safety practices and the understanding of duty of care.
The Tragic Incident in Ticknall
In 1955, an incident at a well in Ticknall turned into a tragedy that claimed three lives. Mr. Wileman, an employee of T.E. Hopkins & Son Limited, was instructed by the contractor to descend into the well to help a colleague, Mr. Ward, who had encountered difficulties. Both men tragically lost their lives due to toxic fumes in the well.
Adding to the tragedy, Dr. Mark Baker, a respected local GP from Ashby-de-la-Zouch, was called to the scene. Despite warnings from several onlookers, Dr. Baker bravely volunteered to descend into the well in an attempt to save the two men. Sadly, his rescue attempt ended in his own death when the rope he was tied to became stuck against the well wall, leaving him unable to escape the hazardous fumes.
The Legal Implications
This devasting event led to a case brought before the Court of Appeal. Messrs Fishers Solicitors represented T.E. Hopkins & Son Limited, and the case addressed two critical issues:
- Was Hopkins responsible for the death of Dr. Baker by failing to ensure the well was safe before sending the workmen down?
- Did Dr. Baker's voluntary rescue attempt make him responsible for his own death?
The Court of Appeal ruled that as a “rescuer”, Dr. Baker had acted reasonably under the circumstances. Consequently, Hopkins was found liable for negligence. This ruling emphasised the importance of workplace safety and the duty of care employers owe to all individuals impacted by their operations.
Honouring Dr. Mark Baker
In recognition of his heroism, a plaque was erected in 2024 on Market Street, Ashby-de-la-Zouch, commemorating Dr. Baker’s extraordinary courage and sacrifice.
