Property matters relating to separation
20 October 2025 | Civil Partnership Law |
In any separation, deciding what happens to your home is often one of the biggest issues that needs resolving. Where you own a home with your partner, we can help reach a fair settlement on what happens to the property, including who gets to keep possession and what financial compensation the other party will receive.
Disputes between couples have many complex and unpredictable implications. Financial and property claims within divorce cause a lot of distress and can have lasting consequences for the couple and children. We will help you to resolve matters in a positive and compassionate manner and will provide resourceful, sound and progressive advice. As expert solicitors we are used to solving disputes of all kinds, therefore we are best placed to work with you to get you the best possible outcome.
We can also help with settlements relating to any other property you own, including commercial property and residential buy-to-let property. This includes advising on any tax implications involved in the sale of property.
If you would like to resolve financial and property matters with your former spouse once and for all, a financial order from the family court is required. Obtaining decree absolute does not mean that financial difficulties will be resolved immediately, and the financial claims resulting from the dissolution of the marriage will remain open.
We propose that at the same time as the divorce proceeds, you settle the financial entitlements that you and your spouse have in relation to cash, property, pensions, investments and assets of any kind as well any income claims (ie maintenance). This would ensure there is a financial clean break and that no further claims can be made by either side.
