My mum is losing her mental capacity – is it too late to get an LPA in place?

This can be such a difficult time. You’re watching your loved one start to struggle and you just want to do the best you can for them. At the same time, you’re trying to juggle your own day-to-day responsibilities. A Lasting Power of Attorney (or LPA) can make that process much more straightforward.

There are two different kinds of LPA, one that will allow you to look after your mum’s finances and another that lets you make decisions about her health and welfare. Creating these means that your mum can decide who she would like to be her advocate when she’s unable to decide for herself.

A formal capacity assessment will increase the costs of the overall process as they’re usually organised by a private firm. They’re often carried out by specially trained social worker or a geriatrician instructed by a private firm.

We know that assessing capacity isn’t always easy. Your mum may be experiencing issues with her speech but still be capable of making her own choices about managing her money or how she wants to be cared for.

If your mum still has capacity, we’ll help her to create an LPA that meets her needs. If not, you’ll need to make a deputyship application, with which we can also help you.
