How to Get a Divorce in the UK: Step-by-Step Guide

Divorce can feel overwhelming, but if both parties agree to end the marriage, the process in England and Wales is usually straightforward. Understanding each stage can make it easier to manage and help you move forward with confidence.


Here is a clear guide to the divorce process in the UK:


1. Issue a Divorce Petition

The first step in getting a divorce is to apply for a divorce petition. You can complete this online via the government’s divorce service or send your documents to the Centralised Divorce Unit by post.


2. Court Notifies Your Spouse

Once your petition has been issued, the court sends it to your spouse — known as the respondent. This can be done by post or through the online divorce portal, officially notifying them that proceedings have begun.


3. Acknowledgment of Service

Your spouse must then complete an Acknowledgment of Service form, confirming they’ve received the petition and stating whether they intend to contest the divorce.


4. Apply for a Decree Nisi

If your spouse does not defend the divorce, you can apply for a Decree Nisi — a court order confirming that you are entitled to a divorce. You’ll need to submit a short supporting statement, verifying that the details in your application are correct.


5. Court Pronouncement

The court will review your application and, if satisfied, issue a Certificate of Entitlement to Decree Nisi. A date will then be set for the Decree Nisi to be pronounced in court — this marks the penultimate stage of the divorce process.


6. Apply for Decree Absolute

After a waiting period of six weeks and one day, you can apply for a Decree Absolute. This is the final order that legally ends your marriage. Once granted, you’ll receive a Certificate of Decree Absolute, confirming that you are officially divorced.
